本隐私政策适用于由成都佳屿晨曦数字科技合伙企业(普通合伙)(下称“我们”或“服务提供方”)开发并运营的 “加个锤子” 应用程序(下称“本App”)。

我们深知个人信息对您的重要性,并致力于保护您的隐私。同时,我们承诺,我们将按业界成熟的安全标准,采取相应的安全保护措施来保护您的个人信息。为了向您提供产品/服务(以下统称"服务")及提升服务品质,我们将遵循以下原则,收集、存储、使用、对外提供您的个人信息(以下称"信息"):权责一致原则、目的明确原则、选择同意原则、最小必要原则、确保安全原则、主体参与原则、公开透明原则等。我们尊重您的个人隐私,为此我们特提供以下隐私政策条款,向您说明我们的用户个人信息收集、存储、使用及保护等政策。请在使用本App前,仔细阅读并理解本政策的全部内容。

一、 我们如何收集与使用您的信息

我们将遵循合法、正当、必要的原则,按照下述规定收集、使用您的个人信息。如无法获取并使用必需的用户个人信息,我们可能无法提供相应的服务,如出现此现象,请您给予理解。

1.1 您主动提供的或允许我们收集的个人信息

1.1.1 您在注册账户时提供的信息

在您注册用户账户时,您需要提供手机号、微信号、ios账号等信息。上述注册信息可能被用于您的账户登录、账户管理以及重要行为验证等用途。若您不提供以上信息,您无法完成账号注册、记录加班时长等功能。

1.1.2 您在使用我们的服务时提供的信息

在您使用我们的服务时,您可能提供您的以下个人信息:

  • 通过访问您的手机相册上传您的头像。
  • 为实现“记录加班时长”与“估算加班薪酬”的核心功能,我们需要您主动输入相关信息,例如您的月薪数额与每日工作起止时间。这些信息是计算功能所必需的数据。
  • 相册读写权限:用于木鱼与相关背景图设置,或自定义小组件背景图。若拒绝此权限将无法实现以上功能,但可正常使用其他功能。
  • 责任承担:您理解并同意,您在使用本服务过程中上传、制作、生成、发布、传播的任何内容(包括但不限于图片、照片、声音、音频、绘图、文本等,以下简称“用户内容”),均由您本人独立承担全部法律责任。您应保证对该等内容享有完整、合法的权利或已获得充分授权,且该等内容不违反任何法律法规、政策及公序良俗,不侵犯任何第三方的合法权益(包括但不限于知识产权、肖像权、名誉权、隐私权等)。
  • 我们在此提示您,如无必要,请您尽量不提供您的敏感个人信息;在您与其他用户(好友)互动过程中,也请勿轻易透露您的个人信息。
  • 平台权利:
    • (a) 为维护健康有序的网络环境,若平台通过技术筛查、人工审核或接到第三方投诉举报,发现您上传或您自定义制作的内容涉嫌违反法律法规、本协议约定或平台公布的其他规则,平台有权不经通知随时采取包括但不限于屏蔽、删除、断开链接、限制功能、暂停或终止向您提供服务等措施,并视情况向有关主管部门报告。
    • (b) 平台依据本条采取前述措施,系履行法律法规规定的义务或行使合同赋予的权利,不构成对您任何责任的免除或减轻,亦不意味着平台对该等内容合法性、真实性、准确性作出任何明示或默示的保证或认可。
    • (c) 如因用户内容引发任何争议、索赔或导致平台遭受任何损失(包括但不限于行政罚款、赔偿金、律师费、诉讼费等),您应负责解决并赔偿平台因此遭受的全部损失。

1.2 我们主动收集的个人信息

1.2.1 设备、软件信息

如了解用户使用的设备与系统信息,为诊断及修正软件错误、升级软件提供帮助;在用户注册账号时,我们将读取用户设备信息。

1.2.2 日志信息

在您使用我们的服务过程中,我们可能收集您的设备及软件操作记录、运行故障等信息。我们将搜集用户使用软件的行为,例如使用软件的次数、访问了哪些页面、使用了哪些功能等。这将帮助我们了解用户的需求,使我们可以集中力量开发对用户最有用的功能。此外,我们也会收集软件运行故障记录,帮助诊断和修复软件错误。

请注意,单独的设备信息、日志信息是无法识别特定自然人身份的信息。

1.3 app 权限获取说明

1.3.1 相机权限及照片和媒体权限

为了使您可以设置个人账号头像图片、木鱼与相关背景图设置,当您安装app 时或在我们收集您的个人信息时,我们可能会向您申请获取此权限。

1.3.2 麦克风权限

为了使您获得自定义音效功能,当您安装app 时或在我们收集您的个人信息时,我们可能会向您申请获取麦克风权限。

1.4 我们如何使用收集的个人信息

1.4.1我们将收集的个人信息用于满足您的服务请求,如用户登录账户验证等请求。

1.4.2我们可能会对收集的信息进行综合分析和研究,以便我们根据分析结果优化我们的服务。

1.4.3我们将收集的信息用于网络、软件安全检测及防范。

1.4.4我们将收集的个人信息用于排查软件错误。

1.4.5发送通知及营销信息

1.4.6我们可能会通过系统公告、系统通知、站内信、电子邮件等方式向您发送通知或营销信息。如您不希望接收不是提供服务所必需的通知或营销信息,您可以根据我们的提示选择退订该通知或营销信息。

1.4.7在我们提供免费服务时,我们可能在软件平台上投放广告,如果没有广告收入,我们将不能持续提供免费服务。

1.4.8本政策中另行规定的个人信息使用方式。

1.4.9我们不会收集您移动设备的精确地理位置信息。

1.4.10未经您明确同意,我们不会将您的个人信息用于本政策未载明的其他目的,或将其提供给无关的第三方。

1.5 依据相关法律法规,在下述情形下,我们可能会依法收集、使用您的个人信息但无需征得您的同意:

1.5.1国家安全、公共安全、公共利益需要;

1.5.2法律、法规或强制性行政/司法要求;

1.5.3在紧急状态下,为维护您或他人重大利益需要但又很难得到您本人同意的;

1.5.4您的个人信息属于您自行向社会公众公开的;

1.5.5签署、履行我们与您之间的服务合同所必需;

1.5.6维持我们提供的产品/服务安全稳定运行所必需,例如发现、处置服务故障;

1.5.7法律、法规规定的情形。

二、 信息的共享与披露

2.1我们不会与本公司以外的任何公司、组织和个人分享您的个人信息,但以下情况除外:

2.1.1在获得明确同意的情况下共享:获得您的明确同意后,我们会与其他方共享您的个人信息。

2.1.2我们可能会根据法律法规规定,或按政府主管部门的强制性要求,对外共享您的个人信息。

2.1.3我们可能会将您的个人信息与我们的关联方共享。但我们只会共享必要的个人信息,且受本隐私政策中所声明目的的约束。我们的关联方如要改变个人信息的处理目的,将再次征求您的授权同意。

2.1.4与授权合作伙伴共享:仅为实现本政策中声明的目的,我们的某些服务将由授权合作伙伴提供。我们可能会与合作伙伴共享您的某些个人信息。我们仅会出于合法、正当、必要、特定、明确的目的共享您的个人信息,并且只会共享提供服务所必要的个人信息。我们的合作伙伴无权将共享的个人信息用于任何其他用途。

2.2目前,我们的授权合作伙伴包括以下类型:

2.2.1上述第三方包括我们的关联方、合作伙伴。如我们与第三方分享您的个人信息,我们将遵循合法、正当、必要的原则,并进行安全评估。如该第三方为我们的关联方,我们将确保该第三方将严格依照本政策之规定存储、保护、使用您的个人信息。如该第三方为合作伙伴,我们将事先征得或确认该第三方已征得您对分享信息行为的明示同意。

2.2.2我们可能会接入第三方机构来委托市场销售、技术服务、客户关系服务、信息推送服务、支付服务、数据分析服务、错误报告服务等机构代理我们向您提供服务。第三方机构应对用户的个人信息采取保护措施。若第三方违反法律、法规之规定,该第三方须承担法律责任。

2.3公开披露信息

我们仅会在以下情形下对外公开披露已收集的个人信息:

2.3.1我们将会事先征得您的明确同意。

2.3.2基于法律、法规的要求、强制性的行政执法或司法要求所必须提供您个人信息的情况下,我们可能会依据所要求的个人信息类型和披露方式公开披露您的个人信息。在符合法律法规的前提下,当我们收到上述披露信息的请求时,我们会要求必须出具与之相应的法律文件、如传票或调查函。

2.4 转让信息

我们不会将您的个人信息转让予第三方,但如我们存在公司合并/分立、资产转让等交易情形,必须转让您的个人信息,我们将告知您上述情形,并由受让公司按照不低于本政策的标准继续保护您的个人信息。

三、 我们如何保护您的个人信息

3.1 存储期限

除非法律、法规另行规定,我们将在您终止使用我们提供的服务后停止收集您的个人信息,并在合理期限内将您的个人信息进行删除或匿名化处理。

3.2 个人信息保护

3.2.1 我们已经建立并健全了符合业界标准的安全防护措施保护用户个人信息,我们将以必要和最小授权为原则严格设定用户个人信息访问权限,控制用户个人信息知悉范围。

3.2.2 我们会采取一切合理可行的措施,确保未收集无关的个人信息。我们只会在达成本政策所述目的所需的期限内保留您的信息,除非要延长保留期或受到法律的允许。例如《中华人民共和国电子商务法》要求商品和服务信息、交易信息保存时间自交易完成之日起不少于三年;《中华人民共和国网络安全法》要求留存相关的网络日志不少于六个月。而我们判断前述期限的标准包括:

  • (1)完成与您相关的交易目的,维护相应交易及业务记录、应对您可能的查询或投诉;
  • (2)完成您同意使用的其他业务功能;
  • (3)保证我们为您提供服务的安全与质量;
  • (4)您是否同意更长的留存期间;
  • (5)是否存在保留期限的其他特别规定。

3.2.3 在您的个人信息超出保留期间后,我们会根据适用法律的要求删除您的个人信息,或进行匿名化处理。

3.2.4 互联网环境并非百分之百安全,我们将尽力确保或担保您发送给我们的任何信息的安全性。如果我们的物理、技术、或管理防护设施遭到破坏,导致信息被非授权访问、公开披露、篡改、或毁坏,导致您的合法权益受损,我们将承担相应的法律责任。

3.2.5 如发生个人信息泄露等安全事件,我们将依据法律、法规之规定启动应急预案,阻止安全事件扩大,并向您发送通知,通知内容可能包含:安全事件的基本情况和可能的影响、我们已采取或将要采取的处置措施、您可自主防范和降低风险的建议、对您的补救措施等。我们将及时将事件相关情况以邮件、信函、电话、推送通知等方式告知您,难以逐一告知个人信息主体时,我们会采取合理、有效的方式发布公告。同时,我们还将按照监管部门要求,主动上报个人信息安全事件的处置情况。

3.2.6 请您妥善保管好您的注册账户信息(用户名、密码),如发现上述信息已经泄露,请及时与我们取得联系。

四、 您的权利

按照中国相关的法律、法规、标准,以及其他国家、地区的通行做法,我们保障您对自己的个人信息行使以下权利:

4.1访问您的个人信息

如果您希望访问或更正您账户中的个人信息,您可以通过访问【个人中心】-【个人资料】执行此类操作。

4.2删除您的个人信息

在以下情形中,您可以向我们提出删除个人信息的请求,请通过 ios@peipaypray.com 与我们联系,我们将在合理时间内响应您的请求:

  • (1)如果我们处理个人信息的行为违反法律法规;
  • (2)如果我们收集、使用您的个人信息,却未征得您的同意;
  • (3)如果我们处理个人信息的行为违反了与您的约定;
  • (4)如果您不再使用我们的产品或服务,或您注销了账号;
  • (5)如果我们不再为您提供产品或服务。

4.3撤回您的授权

如果您希望撤回同意收集的信息,请通过 ios@peipaypray.com 与我们联系。

如果您希望撤回已同意的权限,可在手机系统的设置-应用管理-权限处设置撤回。

但请您理解并同意,当您撤回某些授权时,将导致与之相关的产品功能不可用,我们无法继续为您提供撤回同意或授权所对应的特定功能和/或服务,并且您撤回授权的决定不会影响此前基于您的授权而开展的个人信息处理。

4.4个人信息主体注销账户

您随时可注销此前注册的账户,您可以通过以下方式自行操作:

在【个人中心】中进行账号注销。一旦您注销我们APP移动账号,可能会无法使用我们的部分产品和服务,同时您先前积累的数据可能会不可逆地被永久删除,因此请您谨慎考虑。

在注销账户之后,我们将停止为您提供产品或服务,并依据您的要求,删除您的个人信息,法律法规另有规定的除外。

4.5响应您的上述请求

(1)为保障安全,您可能需要提供书面请求,或以其他方式证明您的身份。我们可能会先要求您验证自己的身份,然后再处理您的请求。我们将在十五天内做出答复。

(2)对于您合理的请求,我们原则上不收取费用,但对多次重复、超出合理限度的请求,我们将视情收取一定成本费用。对于那些无端重复、需要过多技术手段(例如,需要开发新系统或从根本上改变现行惯例)、给他人合法权益带来风险或者非常不切实际(例如,涉及备份磁带上存放的信息)的请求,我们可能会予以拒绝。

4.6在以下情形中,按照法律法规要求,我们将无法响应您的请求:

(1)与国家安全、国防安全直接相关的;

(2)与公共安全、公共卫生、重大公共利益直接相关的;

(3)与犯罪侦查、起诉、审判和判决执行等直接相关的;

(4)有充分证据表明您存在主观恶意或滥用权利的;

(5)响应您的请求将导致您或其他个人、组织的合法权益受到严重损害的。

(6)涉及商业秘密的。

五、您的个人信息出境情况

我们会按照《中华人民共和国个人信息保护法》法规的规定,将在中华人民共和国境内收集的个人信息存储在中华人民共和国境内。

六、 未成年人隐私保护

6.1我们的产品与/服务主要面向具有相应的民事行为能力的用户。如您是18周岁以下的未成年人,在您使用我们提供的服务之前,应当事先取得您的监护人的同意。我们非常重视并根据国家相关法律法规的规定保护未成年人的个人信息。

6.2 我们不会主动直接向未成年人收集其个人信息。对于经监护人同意而收集未成年人个人信息的情况,我们只会在受到法律允许、监护人同意或者保护未成年人所必要的情况下使用、共享、转让或披露此信息。

6.3 如果有事实证明未成年人并未取得监护人同意的情况下注册使用了我们的产品与服务,我们会与相关监护人协商,并设法尽快删除相关个人信息。

6.4 如您是未满14周岁的儿童,在您使用我们提供的服务之前,您必须取得您的监护人的同意。如您的监护人不同意您使用我们的服务,请您立即终止使用我们的服务并联系我们。

七、 安全措施

我们采取符合行业标准的管理、技术和物理安全措施(如加密、访问控制)来保护我们所处理的信息,防止其遭到未经授权的访问、披露、使用和修改。

八、本政策如何更新

我们将根据最新法律规定、服务发展状况对本政策做出修订。

未经您明确同意,我们不会削减您按照本隐私政策所应享有的权利。当本政策发生变更时,我们将以弹窗的形式向您发送修订通知。

对于重大变更,我们还会提供给更为显著的通知(包括对于某些服务,我们会通过电子邮件、弹窗、页面提示、网站公告等方式发送通知,说明个人信息保护政策的具体变更内容)。

本政策所指的重大变更包括但不限于:

  • 1、我们的服务模式发生重大变化。如处理个人信息的目的、处理的个人信息类型、个人信息的使用方式等;
  • 2、我们在所有权结构、组织架构等方面发生重大变化。如业务调整、破产并购等引起的所有者变更等;
  • 3、个人信息共享、转让或公开披露的主要对象发生变化;
  • 4、您参与个人信息处理方面的权利及行使方式发生重大变化;
  • 5、我们负责处理个人信息安全的责任部门、联络方式及投诉渠道发生变化时;
  • 6、个人信息安全影响评估报告表明存在高风险时。

我们在此提示您,在您点击弹窗中的同意按钮后,我们才会按照更新后的隐私政策收集、使用、对外提供您的个人信息。

如您不同意我们的更新内容,请及时与我们联系。如无法获取并使用必需的用户个人信息,我们可能无法提供相应的服务,如出现此现象,请您给予理解。

This Privacy Policy applies to the Peipaypray mobile application (the "App") developed and operated by Chengdu JiayuChenxi Digital Technology Partnership (General Partnership) ("we", "us", or the "Service Provider").

We understand the importance of your personal information and are committed to protecting your privacy. We promise to adopt appropriate security measures in line with industry-standard practices to safeguard your personal information. To provide you with products and services (collectively, the "Services") and improve service quality, we will collect, store, use, and disclose your personal information ("information") in accordance with the following principles: consistency of rights and responsibilities, clear purpose, choice and consent, data minimization, security assurance, subject participation, and openness and transparency. We respect your personal privacy and provide this Privacy Policy to explain how we collect, store, use, and protect your personal information. Please read and understand all contents of this Policy carefully before using the App.

I. HOW WE COLLECT AND USE YOUR INFORMATION

We collect and use your personal information in accordance with the principles of lawfulness, fairness, and necessity. If we cannot obtain and use necessary personal information, we may be unable to provide corresponding Services.

1.1 Information you voluntarily provide or allow us to collect

1.1.1 Information you provide when registering an account

When registering a user account, you are required to provide information such as your mobile phone number, WeChat account, or iOS account. Such registration information may be used for account login, account management, and important identity verification. If you do not provide such information, you will be unable to complete account registration or use functions such as overtime recording.

1.1.2 Information you provide when using our Services

When using our Services, you may provide the following personal information:

  • (1) Upload your avatar by accessing your mobile phone photo album.
  • (2) To enable the core functions of "recording overtime hours" and "estimating overtime pay", we require you to actively enter relevant information, such as your monthly salary and daily working hours. Such information is necessary for calculation functions.
  • (3) Photo album read/write permission: used for setting wooden fish and related background images, or custom widget backgrounds. Refusing this permission will disable the above functions but will not affect other normal functions.
  • (4) Liability: You understand and agree that you are solely and fully legally responsible for any content you upload, create, generate, publish, or disseminate while using the Services (including but not limited to pictures, photos, sounds, audio, drawings, and text, hereinafter "User Content"). You warrant that you have full and legitimate rights or sufficient authorization for such content, and that such content does not violate any laws, regulations, policies, public order, or good morals, nor infringe upon the legitimate rights and interests of any third party (including but not limited to intellectual property rights, portrait rights, reputation rights, and privacy rights).
  • (5) We remind you that you should avoid providing sensitive personal information unless necessary. You should also not disclose your personal information casually when interacting with other users (friends).
  • (6) Platform rights:
    • (a) To maintain a healthy and orderly online environment, if the Platform, through technical screening, manual review, or receipt of third-party complaints, finds that your uploaded or customized content violates laws, regulations, this Policy, or other published rules, the Platform reserves the right to take measures including but not limited to blocking, deletion, link removal, function restriction, suspension, or termination of Services without prior notice, and may report to relevant competent authorities as appropriate.
    • (b) The Platform's actions under this clause are performed to fulfill legal obligations or exercise contractual rights, and do not exempt or mitigate any of your liabilities. Nor do they constitute any express or implied warranty or endorsement of the legality, authenticity, or accuracy of such content.
    • (c) If User Content causes any dispute, claim, or loss to the Platform (including but not limited to administrative fines, compensation, attorney fees, and litigation costs), you shall resolve such issues and indemnify the Platform for all losses incurred.

1.2 Information we collect automatically

1.2.1 Device and software information

We collect device and system information to assist in diagnosing and fixing software errors and upgrading software. We will read device information when you register an account.

1.2.2 Log information

When you use our Services, we may collect records of your device and software operations, runtime errors, and other information. We collect usage behavior such as usage frequency, accessed pages, and used functions to understand user needs and prioritize feature development. We also collect software error logs to help diagnose and fix issues.

Note: standalone device information and log information cannot identify a specific natural person.

1.3 App permission requests

1.3.1 Camera, photo, and media library permissions

We may request these permissions when you install the App or when we collect your personal information to allow you to set profile avatars, wooden fish, and related background images.

1.3.2 Microphone permission

We may request microphone permission when you install the App or when we collect your personal information to enable custom sound effects.

1.4 How we use collected personal information

1.4.1 To fulfill your service requests, such as account login verification.

1.4.2 To conduct comprehensive analysis of collected information to optimize our Services.

1.4.3 For network and software security detection and prevention.

1.4.4 For troubleshooting software errors.

1.4.5 Sending notifications and marketing messages.

1.4.6 We may send you notifications or marketing messages via system announcements, system notifications, internal messages, emails, etc. If you do not wish to receive non-essential notifications or marketing messages, you may opt out as prompted.

1.4.7 We may display advertisements in the App to support free Services.

1.4.8 Other uses specified elsewhere in this Policy.

1.4.9 We do not collect precise geographic location information from your mobile device.

1.4.10 We will not use your personal information for purposes not stated in this Policy or provide it to unrelated third parties without your explicit consent.

1.5 Circumstances where we may collect and use personal information without consent

We may collect and use your personal information without obtaining your consent in the following situations as required by applicable laws and regulations:

1.5.1 For national security or public safety;

1.5.2 As required by laws, regulations, or mandatory administrative/judicial orders;

1.5.3 In an emergency to protect vital interests of you or others where consent is impracticable;

1.5.4 Personal information you have voluntarily disclosed to the public;

1.5.5 Necessary for concluding and performing the service contract between you and us;

1.5.6 Necessary to maintain the secure and stable operation of our products/services, such as detecting and resolving service failures;

1.5.7 Other circumstances prescribed by laws and regulations.

II. SHARING AND DISCLOSURE OF INFORMATION

2.1 We will not share your personal information with any companies, organizations, or individuals outside our company except in the following cases:

2.1.1 Sharing with your explicit consent.

2.1.2 Sharing as required by laws, regulations, or mandatory government requirements.

2.1.3 Sharing with our affiliates: we only share necessary information and comply with the purposes stated in this Policy. Affiliates will seek your consent again if they change the purpose of processing.

2.1.4 Sharing with authorized partners: we may share certain personal information with partners only to fulfill the purposes stated in this Policy. We only share information that is lawful, fair, necessary, specific, and limited to service provision. Partners have no right to use shared personal information for any other purpose.

2.2 Our authorized partners include:

2.2.1 Affiliates and business partners. We conduct security assessments and follow the principle of minimization. Affiliates must store, protect, and use information in strict compliance with this Policy. Partners obtain or confirm your explicit consent in advance.

2.2.2 Third parties engaged to provide marketing, technical, customer relationship, messaging, payment, data analysis, or error reporting services. Third parties must adopt measures to protect personal information and shall bear legal responsibility for violations.

2.3 Public disclosure

We will publicly disclose collected personal information only in the following cases:

2.3.1 With your prior explicit consent.

2.3.2 When required by laws, regulations, mandatory administrative, or judicial requirements. We will require appropriate legal documents such as subpoenas.

2.4 Transfer of information

We will not transfer your personal information to third parties except in the event of merger, division, or asset transfer, in which case you will be notified and the transferee will protect your information at a standard no lower than this Policy.

III. HOW WE PROTECT YOUR PERSONAL INFORMATION

3.1 Storage period

Unless otherwise required by laws and regulations, we will cease collecting your personal information after you terminate use of our Services and delete or anonymize your information within a reasonable period.

3.2 Protection of personal information

3.2.1 We have established industry-standard security measures to protect personal information. We strictly limit access to personal information based on necessity and minimum authorization.

3.2.2 We take all reasonably practicable measures to avoid collecting irrelevant personal information. We retain information only for the period necessary to fulfill the purposes stated in this Policy, unless an extended retention period is required or permitted by law.

3.2.3 After the retention period expires, we will delete or anonymize your personal information in accordance with applicable laws.

3.2.4 The internet environment is not completely secure. We endeavor to ensure the security of information you send to us. If our physical, technical, or management protection facilities are compromised, resulting in unauthorized access, disclosure, alteration, or destruction of information and harm to your legitimate rights, we will bear corresponding legal liability.

3.2.5 In the event of a personal information breach, we will activate an emergency plan to contain the incident and notify you of the situation, potential impact, measures taken, risk reduction advice, and remedies. We will notify you via email, letter, phone, or push notification. If individual notice is impractical, we will issue a public announcement. We will also proactively report handling to regulatory authorities as required.

3.2.6 Please keep your account credentials (username, password) secure. If you discover a leak, contact us immediately.

IV. YOUR RIGHTS

In accordance with Chinese laws, regulations, standards, and international practices, we protect your rights over your personal information as follows:

4.1 Access your personal information

You may access or correct personal information in your account via Me - Profile.

4.2 Delete your personal information

You may request deletion of your personal information by contacting us at ios@peipaypray.com in the following cases. We will respond within a reasonable time:

  • (1) Our processing of personal information violates laws and regulations;
  • (2) We collected and used your personal information without your consent;
  • (3) Our processing of personal information breaches our agreement with you;
  • (4) You no longer use our products/services or you have canceled your account;
  • (5) We no longer provide products/services to you.

4.3 Withdraw your consent

You may withdraw consent to information collection by contacting us at ios@peipaypray.com.

You may withdraw granted permissions in your device system settings under Settings - Apps - Permissions.

Withdrawal may disable related functions and will not affect processing performed based on your prior consent.

4.4 Account cancellation

You may cancel your account at any time in Me - Account Cancellation. After cancellation, you may lose access to some Services and your data may be permanently and irreversibly deleted. After cancellation, we will stop providing Services and delete your personal information upon your request, except as required by law.

4.5 Responding to your requests

(1) To ensure security, you may need to verify your identity. We will respond within 15 days.

(2) We generally do not charge fees for reasonable requests but may charge costs for repeated or excessive requests. We may reject requests that are repetitive, require excessive technical measures, risk harming others' legitimate rights, or are impractical.

4.6 Circumstances where we cannot respond to requests

(1) Directly related to national security or national defense;

(2) Directly related to public security, public health, or major public interests;

(3) Directly related to criminal investigation, prosecution, trial, or judgment enforcement;

(4) Sufficient evidence shows bad faith or abuse of rights;

(5) Responding would seriously harm the legitimate rights of you or others;

(6) Involves trade secrets.

V. CROSS-BORDER TRANSFER

We store all personal information collected within the People's Republic of China within the territory of the People's Republic of China in compliance with the Personal Information Protection Law of the People's Republic of China.

VI. PROTECTION OF MINORS

6.1 Our products and Services are intended for users with appropriate civil capacity. If you are a minor under 18, you must obtain consent from your guardian before using our Services. We protect minors' personal information in accordance with applicable laws.

6.2 We do not actively collect personal information directly from minors. When collected with guardian consent, we use, share, transfer, or disclose such information only as permitted by law, with guardian consent, or as necessary to protect minors.

6.3 If we find a minor registered and used our products/services without guardian consent, we will cooperate with the guardian and delete relevant information promptly.

6.4 If you are a child under 14, you must obtain guardian consent before using our Services. If your guardian objects, please stop use immediately and contact us.

VII. SECURITY MEASURES

We employ industry-standard administrative, technical, and physical security measures (including encryption and access control) to protect information from unauthorized access, disclosure, use, and modification.

VIII. UPDATES TO THIS POLICY

We may revise this Policy to reflect legal updates or service changes.

We will not reduce your rights under this Policy without your explicit consent. We will notify you of revisions via in-app pop-ups. For material changes, we will provide prominent notice (email, pop-ups, page alerts, website announcements).

Material changes include but are not limited to:

  • 1. Material changes to our service model (purpose, type, or method of processing personal information);
  • 2. Material changes to ownership or organizational structure (business adjustment, bankruptcy, merger);
  • 3. Changes to main recipients of shared, transferred, or disclosed personal information;
  • 4. Material changes to your rights regarding personal information processing;
  • 5. Changes to the responsible department, contact information, or complaint channel for personal information security;
  • 6. High risk indicated by personal information security impact assessment.

We will collect, use, and disclose your personal information in accordance with the updated Policy only after you click "Agree" in the pop-up.

If you do not agree to updates, please contact us promptly.

本《用户协议》(下称“本协议”)是您(下称“用户”)与“成都佳屿晨曦数字科技合伙企业(普通合伙)”(下称“服务提供方”或“我们”)之间就“加个锤子(Peipaypray)”移动应用程序(下称“本应用”)的使用所订立的法律协议。

本应用需要您购买一次性买断制会员(以下简称“会员”)后方可解锁使用,后续我们将继续开拓更加多元的服务模式。下载、安装或使用本应用,即表示您已阅读、理解并同意接受本协议的所有条款约束。如果您不同意本协议的任何内容,请立即停止使用本应用。

1. 服务的简介、范围、变更、收费与会员

1.1 本应用的核心服务为向您提供加班时间记录、加班数据统计、加班相关信息存档等辅助功能,旨在帮助您便捷管理个人加班情况,仅作为个人记录工具使用。

1.2 本应用提供的具体功能以实际运营中的版本为准。运营方有权根据技术升级、业务调整等情况,对服务内容、功能模块进行变更、暂停或终止,并将尽可能通过应用内公告、推送通知等方式提前告知您。

1.3 您理解并同意,本应用仅提供加班记录的技术服务,不参与您与所在单位之间的劳动关系、加班核算、薪酬结算等事宜,不承担与您单位相关的用工管理、薪酬支付等责任。

1.4 服务提供方致力于优化本应用,并保留随时修改本应用(包括免费及付费功能)的权利。

1.5 您使用本应用时适用的是“一次性买断制会员制度”。

  • a) 性质:会员是一项数字商品。您通过应用内支付一次性支付固定费用后,即可永久性地获得解锁并使用本应用内特定高级功能的许可。该许可是非消耗性的,您无需为此支付任何后续周期性的费用。
  • b) 购买与确认:在您购买会员前,我们会明确展示价格、解锁的功能内容。支付流程需经您明确确认,以确保是您主动、知情的行为。
  • c) 权限范围:会员许可是授予您个人、非排他性、不可转让的使用权。除非本协议另有规定或法律要求,该许可将持续有效。

2. 注册及账号管理

2.1 登录账号:您可以通过手机号码和验证码、微信账号、iOS 账号进行登录。

2.2 您在注册时应具备中华人民共和国法律法规规定的与您的行为相适应的民事行为能力,能够依据法律规定和本协议约定独立承担相应的法律责任。如您未满 18 周岁,请您在监护人陪同下仔细阅读并充分理解本协议,在征得监护人的同意后使用我们的服务。

2.3 请您务必妥善保管您的终端及账户、验证码和/或身份要素信息,并对利用该账户和验证码/身份信息所进行的一切活动负全部责任。您若发现任何非法使用用户账户或安全漏洞的情况应立即通知我们。

2.4 账户注销:

  • 用户可以自行注销账户。
  • 用户违反法律法规、本协议约定或者在线管理规定时,我们可依照相关法律法规或应行政司法执法机关要求注销您的账户。
  • 注销账户后,您将无法使用已注销的账户,也无法查找账户中的任何记录和消息,账户涉及的个人信息将被删除或匿名化处理。

3. 知识产权

3.1 未经服务提供方明确书面许可,严禁复制、修改、改编、反编译、反向工程、试图提取源代码、翻译本应用或创建其衍生版本。与本应用相关的所有商标、版权、数据库权利及其他知识产权均归服务提供方或其合法授权人所有。

3.2 成都佳屿晨曦数字科技合伙企业(普通合伙)是本应用程序的知识产权权利人。本应用程序的著作权、商标权、专利权、商业秘密等知识产权,以及与本应用程序相关的所有信息内容(包括但不限于文字、图片、音频、视频、图表、界面设计、版面框架、有关数据或电子文档等)均受中华人民共和国法律法规和相应的国际条约保护,技术开发方依法享有上述相关知识产权,但相关权利人依照法律规定应享有的权利除外。

3.3 您在使用本服务过程中上传、制作、生成、发布、传播的任何内容(包括但不限于图片、照片、声音、音频、绘图、文本等,以下简称“用户内容”),您应保证对该等内容享有完整、合法的权利或已获得充分授权,且该等内容不违反任何法律法规、政策及公序良俗,不侵犯任何第三方的合法权益(包括但不限于知识产权、肖像权、名誉权、隐私权等)。若产生任何侵权行为,均由您本人独立承担全部法律责任,且若平台通过技术筛查、人工审核或接到第三方投诉举报,发现您上传或您自定义制作的内容涉嫌违反法律法规、本协议约定或平台公布的其他规则,平台有权不经通知随时采取包括但不限于屏蔽、删除、断开链接、限制功能、暂停或终止向您提供服务等措施,并视情况向有关主管部门报告。如因用户内容引发任何争议、索赔或导致平台遭受任何损失(包括但不限于行政罚款、赔偿金、律师费、诉讼费等),您应负责解决并赔偿平台因此遭受的全部损失。

4. 用户责任与设备安全

您有责任保管好自己的设备及登录信息。我们不建议您对设备进行“越狱”或“Root”操作,此类行为可能危及设备安全并导致本应用无法正常运行,由此产生的任何风险和责任由您自行承担。

5. 服务的可用性与免责声明

5.1 网络与设备依赖:本应用部分功能需要有效的互联网连接(Wi-Fi 或移动网络)。您理解并同意,因网络服务中断、设备电力耗尽、设备故障或任何不可抗力因素导致的服务不可用,服务提供方不承担责任,但我们将尽力减少此类中断的影响。

5.2 第三方费用:使用本应用可能产生由您的移动网络运营商收取的数据流量费用(包括国际漫游费)。您应自行承担所有相关通信费用,并遵守与您的运营商签订的协议。

5.3 信息内容:我们力求提供准确的信息,但对于信息的准确性、完整性或及时性,我们不作任何明示或暗示的担保。您应对使用本应用所获取的信息自行判断并承担风险。在法律允许的最大范围内,对于因依赖此类信息而导致的任何直接或间接损失,我们概不负责,但法律法规另有强制性规定的除外。

5.4 您明确知晓并同意,本应用仅作为个人加班记录的辅助工具,所记录的全部加班信息均由您自行输入、上传,本应用仅对您输入的信息进行存储、统计和展示,不对信息的真实性、准确性、完整性进行审核、验证。

5.5 本应用基于您输入的信息生成的加班时长统计、加班费估算等计算结果,仅为您个人参考使用,其准确性完全依赖于您输入信息的真实性和准确性,该计算结果及本应用记录的所有信息,均不能作为您向所在单位或任何第三方主张加班费、补偿金、赔偿金等任何款项的直接证据,也不能作为解决您与所在单位之间劳动争议的依据。因您使用该等信息或计算结果产生的一切纠纷、损失,均由您自行承担,运营方不承担任何责任。

6. 更新与终止

6.1 应用更新:为改进服务或遵守法律法规,我们可能会发布应用更新。我们鼓励您安装更新以获取最佳体验。您可以选择不安装,但部分功能可能因此无法使用。我们不保证所有更新都兼容您的特定设备或操作系统版本。

6.2 服务终止:您可随时停止使用本应用。如我们需要终止向所有用户提供本应用,我们将尽可能提前通过应用内通知或其他合理方式公告。服务终止后,您使用本应用的权利将立即终止。我们建议您自行备份相关数据。

7. 隐私保护

7.1 运营方高度重视您的个人信息保护,将严格遵守《中华人民共和国个人信息保护法》等相关法律法规,采取合理的技术和管理措施保护您的个人信息安全。关于我们如何收集、使用、存储和保护您的个人信息,请详细阅读我们另行制定的《隐私政策》。

7.2 本应用仅收集您自愿提供的个人信息(如注册手机号、加班记录数据等),且收集范围仅限于提供服务所必需。

7.3 运营方不会擅自向第三方泄露您的个人信息,除非获得您的明确授权,或按照法律法规、司法机关、行政机关的要求进行提供。

7.4 您有权要求运营方删除您的个人信息及加班记录数据,运营方将在符合法律法规规定的前提下及时处理。

7.5 请注意,互联网环境存在一定的安全风险,即使运营方已采取相应保护措施,也无法完全避免个人信息被非法获取,您应自行承担相应风险。

8. 协议的变更

我们有权根据需要不时更新本协议。对于重大变更,我们将通过应用内弹窗、网站公告等显著方式通知您。更新后的协议将在公布后生效;当发生有关争议时,以最新的服务条款为准。若您在本协议更新后继续使用本应用,即表示您接受修订后的协议。

9. 法律适用与争议解决

本协议的订立、执行、解释及争议解决均适用中华人民共和国大陆地区法律,如有中英文版本,以中文版本为准。因本协议引起的或与本协议有关的任何争议,双方应首先友好协商解决;协商不成的,任何一方均有权将争议提交至服务提供方住所地有管辖权的人民法院诉讼解决。

10. 不可抗力

10.1 您理解并确认,在使用本服务的过程中,可能会遇到不可抗力等风险因素,使本服务发生中断。不可抗力是指不能预见、不能克服并不能避免且对一方或双方造成重大影响的客观事件,包括但不限于自然灾害如洪水、地震、瘟疫流行和风暴等以及社会事件如战争、动乱、政府行为等。出现上述情况时我们将努力在第一时间与相关单位配合,及时进行修复。由此我们将在法律允许范围内免责。

10.2 本服务同大多数互联网服务一样,受包括但不限于用户原因、网络服务质量、社会环境等因素的差异影响,可能受到各种安全问题的侵扰,如他人利用用户的资料,造成现实生活中的骚扰;您下载安装的其它软件或访问的其他网站中含有病毒,威胁到您的计算机信息和数据的安全,继而影响本服务的正常使用等等。您应加强信息安全及使用者资料的保护意识,要注意加强密码保护,以免遭致损失和骚扰。我们在法律允许范围内免责。

10.3 您理解并确认,我们需要定期或不定期地对服务提供方或相关的设备进行检修或者维护,如因此类情况而造成服务在合理时间内的中断,我们应事先进行通告,我们将在法律允许范围内免责。

User Agreement

Effective Date: December 15, 2025

This User Agreement (the "Agreement") is a legal agreement between you (the "User") and Chengdu JiayuChenxi Digital Technology Partnership (General Partnership) (the "Service Provider" or "we/us") regarding your use of the "Peipaypray" mobile application (the "App").

Access to and use of the App require you to purchase a one-time permanent membership (the "Membership"). We will continue to develop more diverse service models in the future. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by all terms of this Agreement.

1. Service Introduction, Scope, Modification, Fees and Membership

1.1 The core service of the App is to provide auxiliary functions including overtime recording, overtime data statistics, and overtime-related information archiving, to help you conveniently manage your personal overtime status. This App is intended solely as a personal record-keeping tool.

1.2 The specific functions of the App are subject to the version in actual operation. The operator reserves the right to modify, suspend, or terminate service contents and functional modules due to technical upgrades, business adjustments, or other reasons, and will endeavor to notify you in advance via in-app announcements, push notifications, or other means.

1.3 You understand and agree that the App only provides technical services for overtime recording. It does not participate in labor relations, overtime calculation, salary settlement, or other matters between you and your employer, nor does it assume responsibilities related to employment management or salary payment associated with your employer.

1.4 The Service Provider strives to optimize the App and reserves the right to modify the App, including free and paid features, at any time.

1.5 Your use of the App is subject to the one-time permanent membership system.

  • a) Nature: Membership is a digital product. Upon paying a fixed fee via in-app payment on a one-time basis, you permanently obtain a license to unlock and use certain premium features in the App. This license is non-consumable, and you are not required to pay any subsequent recurring fees.
  • b) Purchase and Confirmation: Before you purchase Membership, we will clearly display the price and the features to be unlocked. The payment process requires your explicit confirmation to ensure your action is voluntary and informed.
  • c) Scope of Rights: The Membership license grants you a personal, non-exclusive, non-transferable right of use. Unless otherwise specified in this Agreement or required by law, this license shall remain valid indefinitely.

2. Registration and Account Management

2.1 You may log in using your mobile phone number and verification code, WeChat account, or iOS account.

2.2 When registering, you shall possess the civil capacity appropriate to your conduct as required by the laws and regulations of the People's Republic of China. If you are under 18 years of age, please read and fully understand this Agreement accompanied by your guardian, and use our services only with your guardian's consent.

2.3 You must properly keep your device, account, verification code, and identity credentials, and be fully responsible for all activities conducted using such account and credentials. If you discover any unauthorized use of your user account or security vulnerabilities, you shall notify us immediately.

2.4 Account cancellation:

  • Users may cancel their accounts on their own initiative.
  • If you violate laws and regulations, this Agreement, or online management rules, we may cancel your account in accordance with applicable laws and regulations or at the request of administrative or judicial authorities.
  • After account cancellation, you will no longer be able to use the canceled account or retrieve any records or messages in the account. Your personal information related to the account will be deleted or anonymized.

3. Intellectual Property Rights

3.1 Without the express written permission of the Service Provider, you are strictly prohibited from copying, modifying, adapting, decompiling, reverse-engineering, attempting to extract source code, translating the App, or creating derivative works thereof. All trademarks, copyrights, database rights, and other intellectual property rights related to the App are owned by the Service Provider or its lawful licensors.

3.2 Chengdu JiayuChenxi Digital Technology Partnership (General Partnership) is the intellectual property owner of the App. The copyrights, trademarks, patents, trade secrets, and other intellectual property rights of the App, as well as all information and content related to the App (including but not limited to text, images, audio, video, charts, interface design, layout framework, relevant data or electronic documents), are protected by the laws and regulations of the People's Republic of China and applicable international treaties. The technical developer legally owns the relevant intellectual property rights, except for rights to which relevant obligees are entitled in accordance with the law.

3.3 You warrant that you have full and legitimate rights or sufficient authorization to any content you upload, create, generate, publish, or disseminate while using the services (including but not limited to pictures, photos, sounds, audio, drawings, text, hereinafter referred to as "User Content"), and that such content does not violate any laws, regulations, policies, public order, or good morals, nor infringe upon the legitimate rights and interests of any third party (including but not limited to intellectual property rights, portrait rights, reputation rights, privacy rights, etc.). You shall independently bear full legal liability for any infringement. If the Platform, through technical screening, manual review, or receipt of third-party complaints, finds that your uploaded or customized content violates laws, regulations, terms of this Agreement, or other rules published by the Platform, the Platform reserves the right to take measures including but not limited to blocking, deletion, link removal, function restriction, suspension or termination of services without prior notice, and may report to relevant competent authorities as appropriate. If User Content causes any dispute, claim, or loss to the Platform (including but not limited to administrative fines, compensation, attorney fees, litigation costs), you shall resolve such issues and indemnify the Platform for all losses incurred.

4. User Responsibilities and Device Security

You are responsible for keeping your device and login information secure. We do not recommend you to "jailbreak" or "root" your device. Such actions may compromise device security and cause the App to malfunction. Any risks and liabilities arising therefrom shall be borne by you.

5. Service Availability and Disclaimer

5.1 Network and Device Dependency: Some functions of the App require a valid internet connection. You understand and agree that the Service Provider shall not be liable for service unavailability caused by network outages, device power exhaustion, device failure, or any force majeure events; however, we will endeavor to minimize the impact of such interruptions.

5.2 Third-Party Fees: Use of the App may incur data traffic fees charged by your mobile network operator. You shall bear all relevant communication fees and comply with the agreement with your operator.

5.3 Information Content: We strive to provide accurate information but do not warrant the accuracy, completeness, or timeliness of information. You shall make your own judgment and assume risks regarding information obtained through the App.

5.4 You expressly acknowledge and agree that the App is only an auxiliary tool for personal overtime recording. All overtime information recorded is entered and uploaded by you. The App only stores, counts, and displays the information you enter and does not audit or verify the truthfulness, accuracy, or completeness of such information.

5.5 Calculation results such as overtime duration statistics and overtime pay estimates generated by the App are for your personal reference only. Such results and all information recorded in the App shall not be used as direct evidence to claim payments from your employer or any third party, nor as a basis for resolving labor disputes.

6. Updates and Termination

6.1 App Updates: To improve services or comply with laws and regulations, we may release App updates. We encourage you to install updates for the best experience. You may choose not to install updates, but some functions may become unavailable. We do not guarantee that all updates are compatible with your specific device or operating system version.

6.2 Service Termination: You may stop using the App at any time. If we need to terminate the App for all users, we will endeavor to announce in advance via in-app notices or other reasonable means. Upon service termination, your right to use the App will terminate immediately. We recommend that you back up relevant data on your own.

7. Privacy Protection

7.1 The operator attaches great importance to the protection of your personal information and will strictly comply with the Personal Information Protection Law of the People's Republic of China and other relevant laws and regulations. For details on how we collect, use, store, and protect your personal information, please carefully read our separate Privacy Policy.

7.2 The App only collects personal information you voluntarily provide, such as registered mobile phone number and overtime record data, and the scope of information collection is limited to what is necessary for providing services.

7.3 The operator will not disclose your personal information to third parties without authorization, except with your explicit consent or as required by laws, regulations, judicial authorities, or administrative authorities.

7.4 You have the right to request the operator to delete your personal information and overtime record data. The operator will process such requests in a timely manner in compliance with applicable laws and regulations.

7.5 Please note that the internet environment involves certain security risks. Even if the operator has taken corresponding protective measures, it cannot completely prevent personal information from being illegally obtained, and you shall bear the corresponding risks.

8. Modification of Agreement

We reserve the right to update this Agreement from time to time as needed. For material modifications, we will notify you through prominent means such as in-app pop-ups or website announcements. The revised Agreement shall take effect upon publication. In the event of a dispute, the latest version of the service terms shall prevail.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the mainland of the People's Republic of China. If there is any conflict between the Chinese and English versions, the Chinese version shall prevail. Any dispute arising out of or in connection with this Agreement shall first be settled through friendly consultation. If no settlement can be reached, either party may submit the dispute to the People's Court having jurisdiction at the domicile of the Service Provider.

10. Force Majeure

10.1 You understand and confirm that you may encounter risks such as force majeure during the use of the service, which may interrupt the service. In such cases, we will endeavor to cooperate with relevant authorities and make timely repairs, and we shall be exempt from liability to the extent permitted by law.

10.2 Like most internet services, the service may be affected by various security issues including but not limited to user conduct, network service quality, and social environment. For example, others may use your information to cause harassment in real life; other software you download or other websites you visit may contain viruses that threaten the security of your computer information and data, thereby affecting the normal use of the service. You should strengthen awareness of information security and user data protection, and pay attention to enhancing password protection to avoid losses and harassment. We shall be exempt from liability to the extent permitted by law.

10.3 You understand and confirm that we need to inspect or maintain the Service Provider or related equipment regularly or irregularly. If such maintenance causes service interruption within a reasonable time, we will give prior notice and shall be exempt from liability to the extent permitted by law.
